DISASTER RELIEF FUNDS
NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Burnet County.
REQUEST FOR RELEASE OF FUNDS
On or after March 1, 2013, Burnet County will submit a request to the Texas Department of Agriculture for the release of TxCDBG Disaster Relief funds under Texas Community Development Block Grant (TxCDBG) Section 104(f) Title I of the Housing and Community Development Act of 1974 as Amended, to undertake the following project:
Project Title: Burnet County Water System Improvements
Purpose: Silver Creek Village WSC plans to make water system improvements by replacing their dry well with drilling a new well (78 gpm) on property owned by the WSC. Construction will also consist of installing 1,450 linear feet of three-inch PVC water line, along with all associated appurtenances.
Windermere Oaks WSC intake barge has been damaged in previous rainstorms and needs to be enlarged to stabilize the structure and minimize tipping and damage to the intake pumps. Construction shall consist of installing 208 square feet of steel framing material, barge floats, and all associated appurtenances to the existing intake barge.
Location: Silver Creek Village WSC and Windermere Oaks WSC (both entities located in Burnet County)
Estimated Cost: $298,193
FINDING OF NO SIGNIFICANT IMPACT
Burnet County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Burnet County Courthouse, 220 S. Pierce Street, Burnet, TX and may be examined or copied weekdays 8:00 A.M to 5:00 P.M.
Any individual, group, or agency may submit written comments on the ERR to Burnet County. All comments received by February 28, 2013 will be considered by Burnet County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
Burnet County certifies to the Texas Department of Agriculture that Donna Klaeger in her capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Texas Department of Agriculture’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Burnet County to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
Texas Department of Agriculture will accept objections to its release of fund and Burnet County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Burnet County; (b) Burnet County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Texas Department of Agriculture; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to David Brown at Texas Department of Agriculture, 1700 N. Congress Avenue, Austin, Texas. Potential objectors should contact the Texas Department of Agriculture to verify the actual last day of the objection period.
