Developer at Summit Rock  cries foul, sues

The Golden Bear Reserve at Summit Rock — which owns 21 acres on the Summit Rock Golf Course holes 17 and 18 — has filed a $6 million lawsuit against Horseshoe Bay Resort and partners, alleging wrongful conduct.

Jay Fertig, president of Golden Bear Reserve, said the company that owns and is developing the 1,200 acres surrounding the Summit Rock Golf Course, Summit Rock Communities, LLC, has committed "anti-competitive practices” that have hurt his company’s efforts to sell and develop lots.

In response to the allegations, Horseshoe Bay Resort Chairman Douglas Jaffe Jr. said that the Resort is being represented by Strasburger Price LLC, which has already reviewed the suit.

"Our attorney has looked at it and found that it is absolutely without merit – totally without merit,” Jaffe said. "I think it’s a sad commentary on their part. They wanted to engage (in a suit) but it’s just not fact. I think they ran out of money for their development.”
